It is reported that iron ore minnow FerrAus is working through an infrastructure dispute with BHP Billiton which is on the verge of being debated in court.
Perth based FerrAus recently said it had held discussions with BHP and its Mount Newman joint venture partners in regard to legal action in the West Australian Supreme Court about rail haulage on BHP main railway system in the Pilbara region.
BHP commenced legal proceedings in the WA Supreme Court last Thursday to stop FerrAus appointing an independent expert to determine the terms of a haulage contract between the two companies for BHP Mount Newman line.
FerrAus had to respond to BHP request to cease the appointment of the independent expert by 5 PM on Friday and it is understood the parties have held talks since that deadline in an attempt to avoid legal action.
FerrAus which faces a takeover bid by its major shareholder, Wah Nam had appointed former Australian Competition & Consumer Commission chairman Allan Fels as an independent expert to determine the terms of rail haulage on the Mt Newman line. FerrAus said it would continue to keep the market informed.
